Privacy Policy

At Viralnoise (collectively, “Viralnoise”, “we”, “us”, or “our”), we recognize that your privacy is important. This Privacy Policy sets forth the basis on which the personal data collected from you, or that you provide to us will be processed by us, as well as related products and services we may offer to you (collectively referred to as the “Services”). Please read the information below to learn the following regarding your use of Viralnoise and our Services.

You acknowledge that this Privacy Policy is designed to be read in connection with the Viralnoise Terms of Use, and that by accessing or using Viralnoise, you agree to be bound by the Viralnoise terms and conditions, as well as this Privacy Policy.

We reserve the right to change this Privacy Policy from time to time. We will notify you about substantive changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our site, and/or by updating this Privacy Policy. Your continued use of Viralnoise and/or the Services after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) your agreement to abide and be bound by that Privacy Policy.

IMPORTANT: BY USING VIRALNOISE AND/OR THE SERVICES, YOU GIVE YOUR CONSENT THAT ALL PERSONAL DATA YOU SUBMIT MAY BE PROCESSED BY US IN THE MANNER AND FOR THE PURPOSES DESCRIBED BELOW. IF YOU DO NOT AGREE TO THIS PROVACY POLICY, DO NOT USE VIRALNOISE.

1. TYPES OF INFORMATION WE COLLECT. We collect two types of information about our users: Personally Identifiable Information (“PII”) and Aggregate Information.

1.1. PERSONALLY IDENTIFIABLE INFORMATION. PII is information that lets us know who you are. When you engage in certain activities on Viralnoise, including registering for an account, downloading content, purchasing a product or, posting content, or sending us feedback, we may ask you to provide certain information about yourself.Examples of PII include your first and last name, email address, billing address (including ZIP code), IP address, and other identifying information.

1.2. AGGREGATE INFORMATION. This includes information which by itself does not identify you as a specific individual. We may gather information about you depending upon pages you visit on Viralnoise and what other sites may have directed you to us. This information is collected in various ways, is compiled and analyzed on both a personal and an aggregated basis and may include the Website’s Uniform Resource Locator (“URL”) that points to the site you just came from, which URL you go to after visiting Viralnoise, what browser you are using, and your Internet Protocol (“IP”) address.

2. HOW WE COLLECT AND USE INFORMATION.

2.1. PII COLLECTION. We do not collect any PII about you unless you voluntarily provide it to us. You may be required to provide certain PII to us if you decide to use certain products or services available through Viralnoise, which may include: (a) registering for a Viralnoise account; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from third parties; (d) sending us an email message; or (e) submitting a form or transmitting other information by telephone or letter. When processing certain information, we encrypt the transaction, using Secure Socket Layer (SSL) encryption technology, in order to prevent your PII from being stolen or intercepted.

2.2. PII USE. We primarily use your PII to provide you with products or services. We may also use certain PII to (a) enhance the operation of Viralnoise; (b) improve our internal marketing and promotional efforts; (c) statistically analyze Site use; (d) improve our product and service offerings; (e) customize the Viralnoise content, layout, and Services; and/or (f) deliver information to you and to contact you regarding administrative notices. Additionally, we may use your PII to resolve disputes, troubleshoot problems and enforce our agreements with you, including the Viralnoise Terms of Use, and this Privacy Policy.

2.3. AGGREGATE INFORMATION. We may also collect certain Aggregate Information. By way of example, we may use your IP address to diagnose problems with our servers, software, to administer Viralnoise and to gather demographic information.

3. COOKIES.

Depending on how you use Viralnoise, we may store cookies on your computer in order to collect certain aggregate data about our users and to customize certain aspects of your specific user experience. Cookies are very small data text files stored on your computer when you visit websites that uniquely identifies your browser. Cookies may also include more personalized information, such as your IP address, browser type, the server your computer is logged onto, the area code and ZIP code associated with your server, and your first name to welcome you back to Viralnoise. We may use cookies to perform tasks such as: (a) monitoring aggregate site usage metrics; (b) remembering what playlists you have created; (c) storing and remembering your passwords (if you allow us to do so); (d) storing account and advertising preferences that you have set; and (e) personalizing the Services we make available to you on Viralnoise. We do not use cookies to track your browsing behaviors. Most browsers are initially set up to accept cookies.You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. Please note that some aspects of Viralnoise may not function properly if you elect to disable cookies.

4. RELEASE OF YOUR INFORMATION.

4.1. PARTNER POLICIES. Viralnoise will not share your PII with others. We may provide some of our products and services through contractual arrangements made with affiliates, service providers, partners and other third parties (“Partners”). We and our Partners may need to use some PII to perform tasks between our sites, and/or to deliver products or services to you. The use of your PII by our Partners is governed by the privacy policies of those providers, and is not subject to Viralnoise’s control, and our Privacy Policy only addresses the use and disclosure of information we collect from you, and we are not responsible for the policies or practices of third parties. Other websites accessible through Viralnoise, including our Partners, have their own privacy policies and data collection, use and disclosure practices. Please consult each Partner’s privacy policy.

4.2. COMPELLED DISCLOSURE. From time-to-time we may be required by law enforcement or judicial authorities to provide PII to the appropriate governmental authorities. In such cases, we will disclose PII upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

4.3. We may provide Aggregate Information about our customers’ sales, traffic patterns, and related Viralnoise use information to third party advertisers, but this information will not include any PII.

5. CORRECTING INFORMATION.

5.1. YOUR PII. You may access and edit the PII that you provided to us. We ask that you update your PII promptly if it changes. You may change any of your PII in your account online at any time by accessing your user account in accordance with instructions posted elsewhere on Viralnoise. 5.2. FROM OTHER SOURCES. If you choose to use features on Viralnoise that connect to your online profiles, accounts or services (including social media accounts) (“Connected Accounts”), we may collect any information that you permit through your settings on those Connected Accounts. For example, if you log in to Viralnoise using your Facebook account and choose to allow Facebook to share your profile with us, we may collect that information.

5.3. ADDITIONAL RIGHTS. Depending on your location, you may have additional rights with respect to your PII including, (a) the right to have the Company delete your personal information, except information we are required to retain, by contacting us at the address listed above; and (b) withdrawal of consent or object to processing (including, in limited circumstances, the right to ask Viralnoise to stop processing your PII, by contacting us at the address listed above.Viralnoise may delete your PII if we are instructed to do so by our customers who export your PII to us, except for information we are required to retain.

6. USER CHOICES ON COLLECTION AND USE OF INFORMATION.

6.1. SOLICITATIONS. If you indicated upon registration that you are interested in receiving offers or information from us and our Partners, then, depending upon your election, we may from time to time, send you emails and/or SMS or direct messages, call you or send you direct mail about products and services that may be of interest to you. Only Viralnoise (or agents working on behalf of Viralnoise and under confidentiality agreements) will send you these solicitations, and only if you have previously indicated that you wish to receive them. If you change your mind, you can “opt-out” at any time by accessing your account online and editing your account information to no longer receive such offers and mailings.

6.2. COOKIES. You also have choices with respect to cookies, as described above. By modifying your browser preferences, you may have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of Viralnoise may not work properly in all instances.

7. SECURITY OF YOUR PII.

7.1. BY US. Viralnoise takes appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of your PII, including, by: (a) we encrypt all PII; (b) we use PII only for the purposes for which it was collected or to comply with any applicable legal or ethical reporting or document retention requirements; (c) we limit access to PII only to specific employees, contractors and agents who have a reasonable need to come into contact with your information; (d) we employ physical, electronic, and procedural safeguards to protect PII, including industry-standard encryption.

7.2. BY YOU. Access by you to your PII is available through a password and unique customer ID selected by you. This password is encrypted. Do not divulge your password to anyone.

7.3. DISCLAIMER. No data transmission over the internet or any wireless network is always 100% secure. While we seek to protect your PII, you acknowledge that: (a) there are security and privacy limitations inherent to the internet and wireless networks which are beyond our control; and (b) the security, integrity and privacy of information and data exchanged between you and us through Viralnoise and otherwise cannot be guaranteed.

8. THIRD PARTY SERVICES.

Viralnoise may allow you to connect a YouTube channel to your account on Viralnoise. If you do so, we will access certain information from YouTube about your channel by using YouTube API Services, and we may store your channel ID for reference when creating licenses, and this information will be also treated in accordance with this Privacy Policy. We may share your channel ID with any content ID licensing partner we may contract with, if any, to facilitate our content ID licensing. If you decide to connect a YouTube channel to your Viralnoise account, you will also be subject to Google’s privacy policy available here: https://www.google.com/policies/privacy. If you disconnect a YouTube channel on Viralnoise, we will delete the stored data associated with that YouTube channel. You may also revoke access to the data we collect via the YouTube API Services by changing your security settings on Google here: https://security.google.com/settings/security/permissions.

9. MISCELLANEOUS.

9.1. AGE. You must (i) be at least 18-years old or (ii) as parent or guardian, you agree to this Privacy Policy and authorize your child who is between the age of 16 and 18 to use Viralnoise, the Content or Services, subject to your responsibility for their conduct, to have our permission to use Viralnoise. Our policy is that we do not knowingly collect, use or disclose PII about children under the age of 13.

9.2. YOUR OWN DISCLOSURE. If you voluntarily disclose any of your PII (e.g., your name, email address, etc.) in the discussion forums or other public areas on Viralnoise, it is possible that such information, along with any information disclosed in your communication, can be collected and used by third parties which may result in unsolicited messages (including spam) from third parties. You acknowledge that this is beyond our control and this Privacy Policy does not apply to information you voluntarily disclose. Please consult the Terms of Use for our conduct policies.
